How our client avoided a criminal record after an unlawful assault charge
The Charge
The offending in this case occurred in the early hours of the morning in Melbourne CBD. There was CCTV footage of the incident although it did not capture the start of the altercation. It was alleged that after a scuffle between our client and the complainant, our client punched the complainant to the face causing a swollen bloodied nose.
The client had no priors for assault-related offences although he has very old drug charges. He was also employed in a senior management role in a well known Melbourne establishment.
The Strategy
We provided legal representation at the Melbourne Magistrates’ Court.
The matter was listed for case conference several months after the date of the alleged offending.
During case conference discussions with the prosecution, the prospect of the matter finalising as a diversion was canvassed. We persuaded the prosecution that it was an appropriate case for diversion and the matter then set down for a diversion hearing.
In preparation for the diversion, we obtained several quality character references. During submissions at the diversion hearing, we raised our client’s excellent employment history, the circumstances of the offending, and his good character as evidenced by the references for the magistrate’s consideration.
The Result
His Honour was eventually persuaded to grant a diversion for the Unlawful Assault and this consequently meant that our client could avoid any disclosable outcome for the offence.

How we prevented our client from going to prison after committing alcohol-fueled violence
The Charge
Our client was charged with Affray, Injury charges, Unlawful Assault, and Assault With a Weapon after drinking one night with his friends in the city and getting involved in a street fight with another group of young men.
Our client didn’t remember his role in the fight but CCTV footage captured it – he was throwing punches, kicking people on the ground, and even throwing a glass bottle. The client had never been in trouble with the police before and was worried about going to jail. Jail was a real possibility given the public’s views of alcohol-fueled violence.
The Strategy
Here’s what we did:
- We watched the footage with the client and explained the seriousness of the assault charges arising from alcohol-fueled violence.
- We explained how important it was to prepare properly for a plea.
- We organized for our client to do an anger management course and an alcohol and drug course to help him understand what led to the offending and gave him tools for handling conflict in a better way next time.
- Character references were also gathered for the client. We made sure that these people came to court on the day.
- We disagreed with the prosecution about which charges should proceed and so we adjourned the matter to a contest mention.
The Result
The magistrate was impressed at the steps our client had taken towards his rehabilitation. The client was offered an adjourned undertaking with a condition that he be of good behaviour for 4 months and that he donate to the court fund.
This was an incredible result for a case of assault charges arising from alcohol-fueled violence.
It is sometimes important not to plead guilty straight away. A good lawyer will know which charges you should plead guilty to and which ones you should fight and will give you sound advice about the best way forward.

How we helped our client avoid jail time after multiple unlawful assault charges
The Charge
Our client was alleged to have repeatedly punched a workmate in the head during an argument, causing him to lose consciousness. The victim was hospitalised and still experiences vision problems flowing from the assault. The assault took place whilst the client was already on a Community Corrections Order for a previous violent offence.
We acted on the client’s behalf at the Heidelberg Magistrates’ Court. The charges were:
- Intentionally Cause Injury
- Recklessly Cause Injury
- Unlawful Assault
The Strategy
The matter continued as a part-heard plea of guilty. We put forward detailed sentencing submissions to the court as to why the client should not receive a term of imprisonment on this occasion.
The Result
Despite the client having several prior matters for violence, and despite the assault charges having been committed whilst on Community Corrections Order, the court ultimately agreed to give the client another chance to avoid jail time. The client was placed on a further Corrections Order with 200 hours of unpaid community work as well as treatment and counselling.
